IDENTITY

Your profile may be deleted and your Registration may be terminated without notice if you are suspected of being under 18 years of age.

a) This Agreement shall remain in full force and effect as long as you continue to use the AKMEDIA DESARROLLO DE CONTENIDOS Services or remain a registered User.
b) You may terminate your Registration at any time, for any reason, by following the instructions on the User's account page. AKMEDIA DESARROLLO DE CONTENIDOS may terminate your Registration at any time without notice. Even after termination of Registration, this Agreement will remain in effect.

AKMEDIA CONTENT DEVELOPMENT CONTENT OWNERSHIP RIGHTS

a) AKMEDIA CONTENT DEVELOPMENT does not claim ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship or any other materials (collectively, the "Content") posted on the AKMEDIA CONTENT DEVELOPMENT Services. After posting Content on the AKMEDIA CONTENT DEVELOPMENT Services, you will retain all ownership rights in such Content and will continue to have the right to use your Content in any way you choose. By displaying or disclosing ("posting") any Content on or through the AKMEDIA CONTENT DEVELOPMENT Services, you hereby grant to AKMEDIA CONTENT DEVELOPMENT a limited license to use, modify, publicly perform, publicly disclose, reproduce and distribute such Content on and through the AKMEDIA CONTENT DEVELOPMENT Services. Without this license AKMEDIA CONTENT DEVELOPMENT will not be able to provide the Services to you.

b) AKMEDIA CONTENT DEVELOPMENT SERVICES include: Advertising Strategy, Creative Services, Digital Marketing, SEM (Search Engine Marketing), SEO (Search Engine Optimization), Social Media Advertising, Content Marketing, Web Design, Branding and Identity, Market Research and Analysis, and Campaign Management. AKMEDIA CONTENT DEVELOPMENT hereby grants you a limited, revocable, non-sublicensable license to reproduce and display the AKMEDIA CONTENT DEVELOPMENT Content (excluding any software code) solely for your personal use when visiting the AKMEDIA CONTENT DEVELOPMENT Website and using the AKMEDIA CONTENT DEVELOPMENT Services.

PROHIBITED CONTENT/ACTIVITY.

The following is a partial list of the kind of Content that is considered illegal or prohibited from being posted on or through the AKMEDIA DESARROLLO DE CONTENIDOS Services. AKMEDIA DESARROLLO DE CONTENIDOS reserves the right to investigate or take appropriate legal action against anyone who, in AKMEDIA DESARROLLO DE CONTENIDOS's sole discretion, violates this provision, including (but not limited to) removing the offending communication from the AKMEDIA DESARROLLO DE CONTENIDOS Services and terminating the Registration of such violators. V) Request personal information from minors under 18 years of age;
VI) Provide telephone numbers, postal addresses, last names, URLs or e-mail addresses;
VI) Promotes information that is false or misleading or promotes illegal conduct or activities that are abusive, threatening, obscene, defamatory or libelous;

VII) Promotes an illegal or unauthorized copy of a third party's copyrighted work such as providing pirated software or links to obtain pirated software, providing information to alter manufacturer-installed copy-protected devices, or providing pirated music or links to pirated music files;

VIII) Involves the transmission of "junk" mail, "chain letters" or bulk mail, instant messaging, spimming or spamming;

IX) contains password or restricted access pages, or hidden images or pages (no link to or from another accessible page);
(X) Favors or promotes any criminal enterprise or activity or promotes information or guidance on illegal activities, including (but not limited to) the manufacture or purchase of illegal weapons, the violation of an individual's privacy, or the provision or creation of computer viruses;
XI) Request passwords or personal identification information from other Users for commercial or unlawful purposes;

XII) Involves commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, barter, advertising or pyramid schemes;

XIII) Include a photograph of a person you have published without that person's consent;

XIV) In profiles of musical groups, using images of a sexual nature or any other type of misleading, abusive or unfair Content with the intention of attracting visits to the profile.

The following is a partial list of types of activities that are illegal or prohibited on the Akmedia Desarrollo de Con AKMEDIA DESARROLLO DE CONTENIDOS Web site and through the use of the AKMEDIA DESARROLLO DE CONTENIDOS Services. AKMEDIA CONTENT DEVELOPMENT reserves the right to investigate and take appropriate legal action against anyone who, in AKMEDIA CONTENT DEVELOPMENT's sole discretion, violates this provision, including (but not limited to) reporting you to the appropriate authorities. Prohibited Activity means (but is not limited to):

a) criminal or tortious activity, including but not limited to child pornography, fraud, trafficking in obscene material, drug trafficking, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement or theft of trade secrets;

It is also a violation of these rules to use any information obtained from the AKMEDIA CONTENT DEVELOPMENT Services for the purpose of contacting, advertising, soliciting or selling to any registered User without their prior explicit consent. In order to protect our Registered Users from advertising or solicitation, AKMEDIA DESARROLLO DE CONTENIDOS reserves the right to restrict the number of emails that a Registered User may send to other Registered Users in any 24-hour period to the number that AKMEDIA DESARROLLO DE CONTENIDOS deems appropriate, in its sole discretion. If you breach this Agreement and send spam, instant messages or other unwanted communications of any kind through the AKMEDIA DESARROLLO DE CONTENIDOS Services, you agree that you have caused substantial damage to AKMEDIA DESARROLLO DE CONTENIDOS, although the extent of such damage would be extremely difficult to determine. As a reasonable estimate of such damage, you agree to pay AKMEDIA CONTENT DEVELOPMENT $150 for each spam, advertisement, junk mail, chain letter or other unwanted communication you knowingly send through the AKMEDIA CONTENT DEVELOPMENT Services, regardless of the number of recipients of such message.

e) attempting to impersonate another Registered User or another person;

f) using the account, username or password of another registered User at any time or disclosing your password to any third party, or allowing any third party to access your account;

g) the sale or transfer of its profile;

h) use of information obtained from the AKMEDIA DESARROLLO DE CONTENIDOS Services to harass, abuse or harm another person;

i) placing advertising on your profile or accepting payment or anything of value from a third party in exchange for the performance of any commercial activity on or through the AKMEDIA DESARROLLO DE CONTENIDOS Services on behalf of such person, such as placing commercial content on the profile, posting blogs or newsletters for a commercial purpose, using the AKMEDIA DESARROLLO DE CONTENIDOS Services in a manner inconsistent with any applicable laws or regulations.

You may not post, modify, distribute or reproduce in any way any copyrighted material, trademarks or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the AKMEDIA CONTENT DEVELOPMENT Services in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work claimed to be infringing; (iii) a description of where the material claimed to be infringing is located on the AKMEDIA CONTENT DEVELOPMENT Services; (iv) your address, telephone number, and mailing address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

PRIVACY

AKMEDIA DESARROLLO DE CONTENIDOS is not responsible for any inaccurate or incorrect Content posted on the [COMPANY URL Pending] Web Site or in conjunction with the AKMEDIA DESARROLLO DE CONTENIDOS Services, whether caused by any equipment or programming associated with or utilized in the AKMEDIA DESARROLLO DE CONTENIDOS Services. Profiles created and posted by registered Users of the AKMEDIA DESARROLLO DE CONTENIDOS Web Site may contain links to other Web sites.
